Acting for parties in claims under the Commerce Act 1986, including:
- acted for the Commerce Commission in Commerce Act penalty hearings for breaches of quality standards imposed on electricity lines service providers under Part 4
- acted for SKY in respect of the SKY/Vodafone merger clearance application and related stay application and appeal
- acting for a defendant in a penalty hearing under the Commerce Act
- acted for Zespri in Commerce Act proceedings brought by Turners & Growers
- acted for Kiwibank and New Zealand Post in the credit card interchange fee litigation brought by the Commerce Commission and retailers
- acted for New Zealand Bus Limited and Infratil Limited in Commerce Act claim brought by the Commerce Commission about the acquisition of shares without a clearance
- acted for Auckland Regional Holdings and Americas Cup Village Limited in Commerce Act claims involving Gulf Harbour
- represented Caltex Oil New Zealand Limited in litigation brought by the Commerce Commission alleging price fixing by petrol companies by removal of free car washes
- represented the Aventis/Rhodia group of companies in a civil claim alleging price fixing of vitamins and in a penalty proceeding brought by the Commerce Commission for that conduct.
Advising parties and representing them on Fair Trading Act and Trade Practices matters, including:
- acted for Sky to obtain summary judgment under the Fair Trading Act about the illegality of pre-loaded Kodi boxes
- acted for Nestlé New Zealand Ltd in a claim against a competitor about misleading and deceptive packaging
- acted for SC Johnson & Son Pty Ltd in a claim by a trade competitor about a television commercial
- acted for a defendant in a penalty hearing under the Fair Trading Act
